Standard Terms & Conditions of Purchase
Payment of a deposit constitutes acceptance of these Terms & Conditions of Purchase.
- Introduction
These Terms and Conditions (“Terms”) apply to all sales of hot tubs, saunas, ice baths, swim spas, pergolas,
and related products (“Goods”) by Outdoorology Ltd, trading as Hot Tubs Rock (“Seller”, “we”, “us”, or “our”)
to customers (“Buyer”, “you”, or “your”) in the UK.
By placing an order with us, you agree to be bound by these Terms. - Orders and Acceptance
2.1 All orders are subject to acceptance by us. We reserve the right to refuse any order without liability.
2.2 The contract is formed upon our written acceptance of your order or upon dispatch of the Goods,
whichever occurs first. - Price and Payment
3.1 All prices quoted by us include VAT at the prevailing rate.
3.2 A non-refundable deposit of 30% of the total price is required at the point of order.
3.3 The remaining balance is payable no later than 7 days before the delivery date.
3.4 Payment can be made via debit card, credit card, or bank transfer into our nominated bank account.
Goods will not be delivered or dispatched until full payment has been received. - Delivery
4.1 Delivery dates are estimates only. While we aim to meet them, we do not guarantee delivery on the
specified date.
4.2 Risk in the Goods passes to you on delivery. Title remains with us until payment in full is received.
4.3 You are responsible for ensuring access to the delivery site and for providing any necessary permissions
or consents.
4.4 We will carry out a site survey prior to delivery to assess the suitability of the location and to advise you of any access requirements, installation considerations, or potential issues. The delivery schedule may be adjusted based on the findings of the survey. - Electrical Work
5.1 An appropriate electrical supply must be in place and ready prior to installation, to allow Hot Tubs Rock to
wire the product in.
5.2 All wiring carried out by Hot Tubs Rock will be completed by an NICEIC-approved contractor.
5.3 Hot Tubs Rock can provide the necessary electrical supply as part of the service; however, this will be
quoted and charged separately. - Consumer Rights and Warranty
6.1 Your statutory rights under the Consumer Rights Act 2015 are not affected by these Terms. You have the
right to receive goods that are as described, of satisfactory quality, and fit for purpose.
6.2 We provide the manufacturer’s warranty on all Goods, details of which will be supplied at the time of
purchase.
6.3 Any defects or issues must be reported to us promptly to allow investigation and resolution.
6.4 For the first 12 months following delivery, Hot Tubs Rock will cover labour costs for any warranty repairs.
After the initial 12-month period, a call-out charge and labour fees will apply unless the customer is
subscribed to either our Premium or Ultimate subscription plan. - Cancellation and Returns
7.1 You have the right to cancel your order within 14 days of receipt under the Consumer Contracts
Regulations, provided the Goods are unused and in their original condition.
7.2 To cancel, notify us in writing within the 14-day period. Return costs are your responsibility unless the
Goods are faulty.
7.3 The 30% deposit is non-refundable once the order is confirmed and production or procurement of the
Goods has commenced.
7.4 Where installation is carried out at your express request during the statutory cancellation period and you
acknowledge that the right to cancel will be lost once installation is complete, you will have no right to cancel
the installation service once completed. If you cancel while installation is in progress, you must pay for the
work carried out up to the point of cancellation.
7.5 If installation has been completed and the Goods have been wired, plumbed or otherwise fixed into
position, the Goods will be treated as inseparably mixed with your property and are not returnable under the
Consumer Contracts Regulations. This does not affect your statutory rights regarding faulty Goods or workmanship.
7.6 If you cancel your order within the statutory 14-day cancellation period and production or procurement has not yet commenced, we will refund your deposit less a £150 administration fee to cover our time and processing costs.
7.7 If we have already incurred costs related to your order (such as delivery from the manufacturer, site-specific preparations, or third-party charges), these expenses will be deducted from your refund in addition to the administration fee. A breakdown of any such deductions will be provided on request. - Liability
8.1 If something goes wrong due to the Goods we’ve supplied, our responsibility (liability) is limited to the
amount you paid for them. We will not be responsible for paying more than the original purchase price under
any circumstances.
8.2 We are not liable for any indirect or consequential losses (for example, loss of earnings, time, or
enjoyment).
8.3 Nothing in these Terms limits or excludes our liability for death or personal injury caused by our
negligence or for anything else we are legally not allowed to exclude. - Force Majeure
We are not liable for failure to perform obligations due to causes beyond our reasonable control including, but
not limited to, acts of God, strikes, or supplier delays. - Data Protection
We will process your personal data in accordance with UK data protection laws. Your details will be used for
order processing and communication only. - Governing Law and Jurisdiction
These Terms shall be governed by English law and subject to the exclusive jurisdiction of the English courts.
